Drafts

During the sessions above, six consolidated drafts of the Convention were generated. Most of these drafts contain important references on the evolution of each article contained therein.

Index to the Travaux Préparatoires

At its forty-second Session in 2009, UNCITRAL requested the preparation of an article-by-article index to the Convention's lengthy travaux préparatoires.

On that basis, the Index to the Travaux Préparatoires includes, primarily, references to paragraphs in the reports of Working Group III, and the summary records and annual reports of UNCITRAL that deal specifically with each article. These reports and records can be seen to most directly reflect the consensus and discussions of Working Group III or UNCITRAL as a whole.

For many articles, there are, in addition, "see also" references to documents that less directly deal with an article, deal with a related article, or are submissions by the Secretariat or individual States. Finally, many articles also contain references to working papers.

For each of the categories listed under any article, all documents are listed in chronological order.

While this Index attempts to be comprehensive, it focuses solely on the travaux préparatoires relating to articles found in the Convention's final text. It does not deal with articles that were considered but later deleted. A Table of Concordance of Chapter and Article Numbers has been prepared to facilitate further research. This table relates the article numbering in the different drafts above to that used in the final text of the Convention. This may be of use because, while it is often clear in the description of the text which article is being discussed, some documents only refer to article numbers.
